1. Acceptance of Terms
1.1 These Terms of Use ("Terms") govern your use of the mobile applications, websites, and related services provided by MouseTech Studios LLC ("MouseTech Studios", "we", "us", "our"), including Lightning Brain and any other app we publish (together, the "Service"). By accessing or using the Service, you agree to be bound by these Terms.
1.2 If you do not agree with these Terms, you may not use the Service. Children under 13 years of age are not permitted to use the Service.
2. Service Description
2.1 MouseTech Studios builds apps and tools for visitors and fans of theme parks, resorts, and cruises. Depending on the app, the Service may include features such as trip planning, location-based information, wait time information, reservation management, checklists, design tools, group organization, and premium features.
2.2 We reserve the right to modify, suspend, or discontinue any part of the Service at any time without prior notice.
3. User Accounts
3.1 Some features may require you to create an account and provide accurate, current information.
3.2 You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account.
3.3 You agree to:
- Provide accurate registration information
- Update your information promptly
- Maintain account security
- Not share your account
- Notify us immediately of any unauthorized use
4. User Conduct and Prohibited Activities
4.1 When using the Service, you agree NOT to:
- Violate any local, state, national, or international law
- Harass, stalk, or harm other users
- Upload offensive, inappropriate, or illegal content
- Attempt to access other users' accounts
- Interfere with the Service's functionality
- Use automated scripts or bots
- Engage in fraudulent activities
4.2 We reserve the right to investigate and take appropriate action against violations, including account termination.
5. Intellectual Property Rights
5.1 The Service and its original content, features, and functionality are owned by MouseTech Studios LLC and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.
5.2 You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material without our prior written consent.
5.3 MouseTech Studios is not affiliated with, endorsed by, or sponsored by The Walt Disney Company or any of its affiliates. All third-party trademarks, service marks, and trade names referenced in the Service belong to their respective owners and are used for identification purposes only.
6. User-Generated Content
6.1 By uploading content (such as photos, designs, or text) to the Service, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and distribute that content in connection with the Service.
6.2 You represent that you own or have the necessary rights to the content you upload and that it does not infringe on third-party rights.
6.3 We may employ automated or AI-powered content moderation and reserve the right to remove any content that violates our guidelines.
7. Subscriptions and Payments
7.1 Some parts of the Service may offer both free and paid tiers, including one-time purchases and recurring subscriptions.
7.2 Purchases are processed through third-party payment providers such as the Apple App Store or Stripe and are subject to those providers' terms of service. Subscriptions purchased through the App Store are managed and cancelled through your Apple account.
7.3 Fees are non-refundable, except where required by law or by the applicable payment provider's policies. Marketplace purchases made through a MouseTech app with its own terms are governed by those terms.
7.4 We may modify pricing with reasonable notice.
8. Privacy and Data Use
8.1 Your use of the Service is also governed by the MouseTech Studios Privacy Policy and, for apps with their own policies, the Lightning Brain Privacy Policy and the ShopMouse Privacy Policy (together, the "Privacy Policy"), which are incorporated into these Terms by reference.
8.2 By using the Service, you consent to our data collection and processing practices as outlined in the Privacy Policy.
8.3 When you delete your account, your personal information is permanently removed from our systems within 30 days. We may retain anonymized, aggregate usage data that cannot be linked back to you, which we use solely to improve app functionality and performance. This data contains no personal identifiers and is not associated with your account in any way. Where an app processes payments, financial records are retained with personal identifiers removed for as long as tax and payment rules require. That app's privacy policy says what is kept. 9. Disclaimers and Limitations of Liability
9.1 THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED.
9.2 WE DO NOT GUARANTEE:
- Continuous, uninterrupted, or error-free service
- Absolute accuracy of park, resort, cruise, wait time, schedule, or other third-party information
- Prevention of data breaches
9.3 IN NO EVENT SHALL MOUSETECH STUDIOS LLC BE LIABLE FOR:
- DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
- LOSS OF PROFITS, DATA, OR USE
- EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES
10. Indemnification
10.1 You agree to indemnify and hold harmless MouseTech Studios LLC from any claims, losses, liability, demands, or expenses arising from:
- Your use of the Service
- Violation of these Terms
- Violation of any rights of another party
11. Dispute Resolution
11.1 Any disputes shall be resolved through binding arbitration in accordance with American Arbitration Association rules.
11.2 Arbitration will occur in the county of MouseTech Studios LLC's primary business location.
11.3 Class action waivers apply; disputes will be resolved on an individual basis.
12. Modifications to Terms
12.1 We may revise these Terms at any time.
12.2 Continued use of the Service after changes constitutes acceptance of the new Terms.
13. Governing Law
13.1 These Terms are governed by the laws of the State of Minnesota, without regard to its conflict of law principles.

15. Severability
